115 Advisory Committee will be meeting again to discuss the comments with the DNR staff.   This meeting will probably occur in early March.   The Advisory Committee will decide how the NR 115 draft proposal will be revised based on comments received at the listening sessions.   Hopefully after that the revised NR 115 proposal will go to the Natural Resource Board.   You can check the DNR website on shoreland zoning for detailed

West Central District

Report

The West Central Zoning Administrators met on December 10th, 2003 for the annual end of the year meeting.  Discussions ranged from training for office support staff, current court cases, variances, NR 115, new elections for President and Secretary/Treasurer.

 

The main discussion revolved around the McGinnity/Ziervogel vs. Washington County, which was to be heard by the State Supreme Court on the following Thursday.  The main arguments where (1) In determining whether to grant a variance, is the local board of adjustment required to first consider whether the requested variance conflicts with the public interest underlying the zoning law at issue before applying the "no reasonable use" test?  And (2) Does a strictly vertical expansion of a residence on a property with a legally non-conforming shoreland setback conflict with the public interest underlying the setback requirement?

 

The WCZA will be scheduling a zoning support staff-training day for sometime in June/July of 2004. Preliminary ideas centered on having speakers from Safety and Buildings and the local technical college. This program will probably run concurrent to the WCZA’s meeting in June/July.

 

The WCZA reviewed the public comment sheets for the revision to NR 115 and tried to come to some type of consensus on the revisions. This was an interesting process due to the fact that we had consensus on some issues, but others the opinions ranged from yes, no, maybe, who cares, etc.

 

So, the meeting ended with the final fireworks of the elections.  I was re-elected (must be doing an excellent job – or is it that I was the only one nominated, hmmmm??) as president and Nate Sampson, Buffalo County was re-elected as Treasurer/Secretary.

Northwest District

Greetings from the Great Northwest.  Winters in days gone by were times to catch up, reflect back, and plan for the future.  It seems those days are forever gone.  Even when temp’s are below zero and three feet of snow is on the ground the continual onslaught of conditional use, rezone, text amendments, and now the compatibility issues between land use plans and the zoning ordinances keeps us busy and honing our multi-tasking skills.

 

Our district has met almost every month.  We have new ZA’s Mark Steward in Rusk Co and Webb Macomber I Washburn Co.  New sanitary code people and are seeing a turnover of staff in our line of work.  To better serve all the members of the district our meetings have been work sessions to share the knowledge and work experiences we deal with on a daily basis.  The issues such as discussion regarding revisions of NR115, NR116, implementation of NR135 the what and how NR216 will be administered by the DNR, collaborating on COMM83, condo campground issues, pending legislation, what to do with the Uniform Dwelling Code, and how to survive in the future, keeps discussions lively.

 

These meetings were a tremendous resource to me when I first became involved in the zoning world and my goal is to continue to provide a strong nucleus and network of dedicated and educated individuals to effectively deal with the ever increasing challenges we all face in being responsible for land use issues and the development of our individuals counties.  It’s still America and we have the ability to make a difference.

EPA Regulations for Wastewater Discharge from Vehicle Maintenance Areas

 

The EPA Underground Injection Control rule that regulates discharges into soil absorption systems does not have a permanent grandfather clause but it does have a delayed date for existing facilities to get into compliance. The rule was effective in April of 2000 with a 7 year compliance date for existing facilities. It is still not clear exactly what EPA will require an existing facility to do. A separate holding tank to serve the vehicle maintenance area is one way to comply.  Note that it is vehicle maintenance activities that cannot be connected to a soil absorption system. Catch basins from garages that only wash the outside of vehicles and/or park vehicles can legally be connected to a soil absorption system with DNR concurrence.  If you have any questions about this topic, contact Jerry Rodenburg at 608.266.7715.
